Since the labor code changed six years ago it is very important for contractors to get a 2810 compliance form signed and notarized before a security service begins work on a job site. This change in the labor code makes the builder responsible for all unpaid wages and taxes if they are not paid by the security service. As most builders know so called trailer guards are not paid for all their hours in an attempt to bid cheap. Most of these companies only pay the security guard for half of their time and tell the guard the unpaid hours are sleep time hours or off duty time. When the job nears completion the security guard gets a labor attorney and files suit for his unpaid wages. (about 1,000.00 dollars per week as they are all double time hours). |
